A number of residents in South Buncombe County near Asheville are dealing with contaminated drinking water wells.  The contaminated water is near an former CTS industrial site.  EPA testing first discovered contamination in soil and stream samples in 1990, but the groundwater wasn’t tested. In July 1999, the chemical trichloroethylene, or TCE, was found in a drinking water well near the site. As reported by the Raleigh News and Observer, a cement plant planned for New Hanover County will not open until a full environmental impact review is considered.

Trial court Judge Donald Stephens recently ruled that a full review of the effect on air, water, and the surrounding community must be complete before the state allows an international company to start building a cement plant in New Hanover County.

The ruling is a setback for Titan America, which wants to build a plant that would produce 2.2 million tons of cement a year and release pollutants such as mercury and greenhouse gases.

The Town of Benson, North Carolina will hook up municipal water to 21 properties in Benson contaminated by leaking petroleum products including MTBE.  For more information, click here

As reported by USA Today, on starting April 22, contractors who work on pre-1978 houses must be certified in lead-based paint safe practices. 

Indeed, this is a good thing for children as lead poisoning can result from improper lead-based paint practices during renovations.

 As reported by the Kansas City Star, a Kansas jury awarded $11 million today to neighboring farmers who sued a factory farm operation saying hog odors were so bad they couldn’t go outside.

Members of Congress from North Carolina have been pushing the United States Navy to evaluate the possible link between decades of water contamination and cancer found among former residents of Camp Lejuene in Jacksonville.  As reported by the News & Observer, the Navy is not willing to fund the study despite indications that thousands of people were exposed to carcinogenic chemicals in their drinking water.  As lawyers and residents of North Carolina, we certainly hope that the U.S. Government addresses this terrible situation for the people that drank the contaminated water.
