There are typically three causes of action that are brought in North Carolina against insurance companies when a property loss claim is denied. Because an insurance policy is a type of legal contract, the first and most obvious claim is for breach of contract. Through the breach of contract claim, the lawsuit will contend that the insurance company breached the insurance policy by not paying the claim.
In addition to a breach of contract claim, if the conduct of the insurance company is particularly bad, the case may also involve a bad faith claim. Bad faith claims can often include a claim for violation of the North Carolina Unfair and Deceptive trade Practices Act which allows for treble damages and attorneys fees to the prevailing party.
Finally, we regularly include a claim for Declaratory Judgment when suing an insurance company. A Declaratory Judgment is a general claim that asks that the court determine that the insurance policy provides coverage for the claim.
