A terrible workplace accident in Gaston County, North Carolina has resulted in the death of a man from Clover, North Carolina.
The accident apparently happened when Victor Towery was struck by an excavator on Monday at a construction site. The North Carolina Department of Labor is investigating the incident which is standard procedure for a workplace fatality. Mr. Towery was working for A&A Grading at the site.
This is obviously a terrible accident and our sympathies are with the Towery family. Hopefully the state investigation will provide some indications as to what happened. Often times in these types of incidents, we find that someone other than the employee is responsible for what happened. If that is the case here, Mr. Towery’s family may have a claim that is outside the traditional worker’s compensation scenario.
