No Charges in Garner Bus Stop Accident That Killed Maria Jimenez

The N.C. Highway Patrol has announced that no charges will be filed against the driver who hit and killed Maria Jimenez near a Garner school bus stop.

What happened in this terrible accident is not clear but reports indicate the young girl crossed Highway 50 into the lane of traffic of the driver.  Apparently, the school bus had its yellow lights on but had not stopped so the red lights and traffic stop arm were not activated.

This accident brings to mind some important legal caselaw that I have recently read involving children and accidents.  This caselaw indicates that drivers who approach areas with children should have a heightened awareness and care because children may be in the area.  Whether this caselaw will affect the outcome of any civil lawsuit in this case is unknown.
