North Carolina motorcycle riders must follow the same basic laws of the roadways as any motor vehicle.

However, there are quite a few North Carolina traffic laws that are very specific to the operation of a motorcycle.  For example, North Carolina General Statute 20-146.1 states that a motorcycle is entitled to the full use of a lane of travel.  In addition, motorcycles are allowed to ride two abreast within any one lane.  This means that two motorcycles can ride side-by-side within a single lane.

A serious motorcycle accident in Moore County, NC near Robbins on Sudany has resulted in multiple injuries.

The accident apparently happened when a car turned in front of two motorcycles near River and Tommy Roads.  Both motorcyclists were hurt and one person was airlifted to an area hospital.

Anyone who is a victim of an accident and has Medicaid must be aware of the Medicaid rules for reimbursement.  A failure to follow the Medicaid rules can lead to criminal chagres against the Medicaid recipient.

The amount that Medicaid can seek in reimbursement is controlled by North Carolina law.  In general, the amount of money that you must re-pay Medicaid is limited to 1/3 of your gross recovery.  However, there are many issues that must be considered when determining how much Medicaid is entiled to (another way of saying this is what is Medicaid’s “lien.”)

You must consider what other medical care providers are entitled to.  You must also consider whether all of the treatment for which Medicaid is claiming a reimbursment is truly related to the accident.  We have handled numerous cases where the statement from medicaid included charges that were not related in any way to the accident claim.  For instance, an accident victim with a broken leg should not need to reimburse Medicaid for a doctor’s visit related to an ear infection.

Motorcyclist Brian Bowden of New Bern, North Carolina was killed on Sunday when a car pulled into his path.

The accident happened on N.C. Highway 43 near the intersection of Wilmar Road.  Apparently, the driver of the vehicle turned off Wilmar Road directly into Mr. Bowden’s path.  Mr. Bowden was taken to Vidant Medical Center in Greenville but did not survive the wreck.

A Raleigh motorcyclist was hit and injured Sunday by a driver that was apparently impaired.

A motorcycle rider in Wilmington, North Carolina was injured Friday after a car cut across traffic striking the motorcyclist.

The accident occurred near the intersection of Dawson Street and 15th Street.  The motorcyclist apparently suffered a broken ankle.

A terrible ATV wreck near Lumberton has claimed the life of passenger Casie Blue.  The wreck apparently happened early on New Year’s Day when another vehicle struck the ATV from behind.

The ATV driver, Guster Scott, was injured while Ms. Blue was tragically killed.  Ms. Blue was 25 years old.  Both the driver of the car and the driver of the ATV, Mr. Scott, have been charged with driving while impaired.

The North Carolina Department of Transportation has released some statistics regarding roadway accidents in 2012.  According to the NCDOT, there were 1224 people killed on North Carolina roadways in 2012.

Of those that were killed, there were 170 pedestrians, 23 bicyclists, and at least 79 motorcyclists.

Motorcyclist Merlin Pogson was seriously injured on Sunday when a car turn into his path.

The accident apparently happened on Mooresville Road on Sunday afternoon.  Mr. Pogson was traveling east on Salisbury Road when the car driver turned into a private residence and crossed the path of Mr. Pogson.  The car driver has been charged with failing to yield while making a left turn.

A terrible motorcycle accident in Brevard, North Carolina has resulted in the death of a motorcyclist.

The accident apparently happened on U.S. 64 near the Sav-Mor Grocery and involved a minivan.  The specific facts of what happened in the accident are not clear.  However, since the accident resulted in a fatality, the N.C. Highway Patrol will likely prepare a detailed report of the accident.
